Request for Inspectorate Intervention – Recovery of Three Unlawfully Plundered Sums and Performance of Statutory Duties
    Dear Inspector Brown,

Your confirmation that Ms Kirsty Martin works at WALGA and not at the Local Government Inspectorate establishes that my statutory notices were misdirected and that the Inspectorate was not functioning for my case. During this period of Inspectorate non‑function, three unlawful extractions occurred under void orders, totalling $31,771.67, affecting both myself and my wife, Mrs Irene Yok Moy Lem.

These losses were not debts owed by us. They arose solely from maladministration, misuse of statutory powers, and enforcement of void orders. They were caused by the actions of others, not by any wrongdoing on our part.

    The three plundered sums are:

$14,264.20 – unlawfully garnished from Irene on 17 September 2025 under the void Hall order.
$2,514.53 – unlawfully garnished from Irene on 18 November 2025, breaching protected balance and Centrelink protections.
$14,993.94 – paid by my son Paul on 24 July 2024 under Sheriff intimidation acting on the void Ward order, facilitated by Birman & Ride.
These actions constitute ultra vires enforcement, misuse of statutory powers, breaches of procedural fairness, and violations of the Local Government Act 1995 (WA), the Fines, Penalties and Infringement Notices Enforcement Act 1994 (WA), and the Australian Consumer Law.

    Your Statutory Duties

    ReplyDelete
  2. Under the Local Government Act 1995 (WA), you hold mandatory duties that arise when credible evidence of maladministration or misuse of powers is presented:

    s. 8.15B and s. 8.15C – duty to investigate suspected non‑compliance, misconduct, or improper use of local government powers.
    s. 8.13 – duty to inquire into whether a local government acted lawfully, fairly, and for proper purpose.
    s. 1.3(2) – duty to uphold fairness, accountability, and transparency.
    s. 3.1 – duty to ensure powers are exercised for proper statutory purpose.
Model Code of Conduct Regulations – duty to ensure honesty, integrity, and avoidance of misleading conduct.
Because the Inspectorate failed to receive my notices due to misdirection to WALGA, the Inspectorate’s own failure contributed directly to the harm suffered. In such circumstances, the obligation to act is heightened.

    Non‑Dereliction of Duty
    Non‑dereliction requires you to:

    take carriage of the matter,
open a formal investigation under ss. 8.13 and 8.15B,
determine responsibility for the unlawful extractions, and
secure the return of the plundered sums totalling $31,771.67.
A refusal to act in the face of clear evidence would constitute a failure to discharge mandatory statutory duties.

    Consequences of Failure to Act
If the Inspectorate declines to act, the matter must be escalated to:

    the Minister for Local Government,
    the Director General,
    the Ombudsman,
and, if necessary, the CCC and Parliament.
    Failure to act may constitute:

    maladministration,
    improper exercise of power,
    failure to consider relevant matters,
    or neglect of statutory obligations.
    Request
    I respectfully request that you:

Open a formal investigation into the unlawful enforcement actions.
Determine responsibility for the three plundered sums.
Exercise your statutory powers to secure the return of $31,771.67 to my family.
Confirm the officer assigned to manage this matter.
I am ready to provide any further documentation you require.

    Kind regards,
    Nicholas N. Chin
