I, Nicholas Ni Kok Chin, of Western Australia, state on oath/affirmation as follows:

1. INTRODUCTION

1.1 I am the Applicant in these proceedings.

1.2 I make this affidavit in support of my application for leave under s.6(1) of the Vexatious Proceedings Restriction Act 2002 (WA).

1.3 Attached to this affidavit and marked “Annexure A” is a document titled “Applicant’s Combined Submission (Insurance, Professional Negligence, and Property Law Issues)”, which sets out:

• the factual background,
• the legislative framework,
• the relevant CHU/QBE policy wording,
• the professional negligence issues,
• the chronology and evidence index, and
• the relief sought.

1.4 Annexure A is also published publicly for transparency.

2. PURPOSE OF THIS AFFIDAVIT

2.1 This affidavit accompanies my application for leave under s.6(1) VPRA.

2.2 I respectfully seek directions from the Court as to:

• whether a further affidavit is required,
• whether the Court requires production of the documents listed in the Evidence Index,
• whether the Court requires a certified copy of Annexure A, and
• any further procedural steps the Court considers appropriate.
