The 1996 amendments relocated the compensation regime into sections 196 and 201–205. These provisions now govern the State’s liability for loss caused by error, omission, misdescription, wrongful registration, or deprivation of an estate or interest in land. The Registrar remains the nominal defendant, and compensation is paid from the Consolidated Account. The modern provisions preserve the substance of the former section 197 while updating the structure and removing the Assurance Fund.
